The Uttar Pradesh GST Department issued Notification No.-749/XI-2-24-9(47)/17-T.C.260-U.P.Act-1-2017-Order-(320)-2024 on August 08, 2024. This notification details the qualifications for Uttar Pradesh officers to be appointed as Technical Members (State) in the State Benches of the Goods and Services Tax Appellate Tribunal (GSTAT).
Key Aspects of the Notification:
The Governor of Uttar Pradesh, following the GST Council’s recommendations, has relaxed the qualification criteria. This relaxation pertains to officers eligible for appointment as Technical Members (State) in the GSTAT State Benches. The notification draws its authority from clause (d) of sub-section (1) of section 110 of the Central Goods and Services Tax Act, 2017 (Act No. 12 of 2017), and its proviso.
Revised Qualification Criteria:
- Previously, candidates needed “twenty-five years of service in Group A, or equivalent.” However, this requirement has been relaxed.
- Now, candidates with “at least twenty-five years of service as a Gazetted Officer” in the Government are eligible for the position.
- This relaxation remains in effect for ten years from the notification’s publication date.
Additional Conditions:
- All other conditions outlined in clause (d) of sub-section (1) of section 110 of the Central Goods and Services Tax Act, 2017, stay the same.
This notification aims to ensure that the GST Appellate Tribunal includes highly qualified and experienced individuals. As a result, it seeks to improve the efficiency and effectiveness of the GST framework in Uttar Pradesh.
