The Central Board of Indirect Taxes and Customs (CBIC) has issued a directive to all divisional heads, emphasizing the need to strictly adhere to guidelines set by the Department of Personnel and Training (DoPT) for the periodic review of government employees. This review process could lead to premature retirements under specific circumstances.
Key Points:
- Periodic Reviews: The CBIC has instructed all field formations to follow the DoPT guidelines dated August 28, 2020, and June 27, 2024. These guidelines mandate regular reviews of government employees to assess their suitability for continued service, with the potential outcome being early retirement.
- Compulsory Retirement Scheme (CRS): Government servants in Groups A, B, and C are subject to review under Rule 56 J&I of the Fundamental Rules, while other government employees are reviewed under Rule 48 of the Central Civil Services (CCS) Pension Rules. Under these provisions, employees may be retired prematurely after reaching the age of 50/55 or after completing 30 years of service if deemed in the public interest.
- Review Committees: The review process is overseen by committees. For Group A officers, the CBIC Chairman heads the committee. For Group B and non-gazetted employees, the committees are led by officers at the Additional Secretary or Joint Secretary level, and departmental heads, respectively.
- DoPT Concerns: During an August 14, 2024, meeting, the DoPT Secretary expressed concerns over the lack of adherence to the guidelines by various ministries. The Secretary highlighted the importance of these reviews in strengthening administration, ensuring efficiency, and maintaining public trust by removing employees with doubtful integrity or ineffectiveness.
