MCA Notifies the Companies (Adjudication of Penalties) Second Amendment Rules, 2024

The Ministry of Corporate Affairs (MCA), through Notification No. G.S.R. 630(E) dated October 09, 2024, has notified the Companies (Adjudication of Penalties) Second Amendment Rules, 2024.
These amendments are made under the powers conferred by Section 454 read with Section 469 of the Companies Act, 2013. The key points of the amendment are:
- The Companies (Adjudication of Penalties) Second Amendment Rules, 2024 will come into force from the date of their publication in the official gazette.
- A proviso has been added to sub-rule (1) of rule 3A, specifying that proceedings pending before the Adjudicating Officer or Regional Director at the time of commencement shall continue under the rules as they existed before the amendment.
