Madras HC to Hear PIL Seeking GST Inclusion for Petrol and Diesel

A Public Interest Litigation (PIL) was filed in the Madras High Court, urging the government to add petrol and diesel to the Goods and Services Tax (GST) system. This change aims to standardize fuel prices across the country.

Chennai-based advocate C. Kanagaraj filed the petition. The court will hear it on Wednesday, September 11, 2024. Acting Chief Justice D. Krishnakumar and Justice P.B. Balaji will review the case. The petition stresses the need for lower and consistent fuel prices across states.

Currently, state governments exclude petrol and diesel from GST because they rely on substantial revenue from independent fuel taxes. Although Section 9(2) of the Central GST Act of 2017 allows for including petroleum products in GST, the GST Council has yet to reach a consensus.

The petitioner argues that including petroleum products in GST would lower fuel prices and benefit consumers. The Union Finance Ministry, the Ministry of Petroleum and Natural Gas, the Tamil Nadu government, and both public and private oil companies face the petition as respondents.
